Training 3: Activating the EU Charter of Fundamental Rights as litigation tool

This section explores how the EU Charter of Fundamental Rights can be used as a powerful tool in strategic litigation. It introduces key Charter rights relevant to older people, including equality, non-discrimination, dignity, health and social protection.

It explains when the Charter applies and how it can complement other European human rights instruments.Through the landmark Mangold case, participants see how litigation can challenge age discrimination and establish principles with an impact beyond the individual case.

The training also introduces different legal routes, including national courts and preliminary references to the CJEU. It highlights practical questions for identifying whether a case raises an EU law issue and how the Charter can support the legal strategy.

Ultimately, it shows how carefully selected cases can create precedents and contribute to broader legal and social change.
